Go-ahead given for setting up Competition Commission

THE much talked about Competition Commission of India (CCI) is on its way to become a reality. The Government is said to have given a go-ahead to establish the Commission with Mr Dipak Chatterjee as the Chairman and Mr Vinod Dhall as Member.

Taking one step at a time, in July this year, under the Competition Act 2002, the Department had formed a core group of officers to start work on the setting up of the Commission. The core group which had been divided into legal, advocacy and administration was set up to complete the ground work before the Commission was established.

The core group has been recruiting staff and building infrastructure for the CCI. It was also framing the rules and regulations to be followed by the Commission. "Government is going step by step in notifying the provisions of the Competition Act. We want a smooth transition from a monopolistic and restrictive trade practices regime to CCI," sources said.

Initially, the CCI is mandated to take up the task of `competition advocacy' to generate wider consciousness of the role of the commission in the wake of the changing economic scenario. The role of CCI set up under the Competition Act, 2002, covers competition advocacy, prohibition of anti-competitive agreements, prohibition of abuse of dominant position, and regulation of combinations (mergers and acquisitions etc., above the prescribed threshold limit).

Further, the CCI is mandated to prohibit practices having adverse appreciable effect on competition, to promote and sustain competition in markets, protect the interest of consumers and to ensure freedom of trade carried on by other participants in Indian markets.
