Kerala HC dismisses Coke's plea

THE Kerala High Court on Friday dismissed a writ petition filed by Hindustan Coca-Cola Beverages Pvt Ltd challenging the second showcause notice issued by the Perumatty Gram Panchayat for closing down its soft drink bottling plant in Plachimada in Palakkad.

Dismissing the petition, Mr Justice K. Balakrishan Nair observed that the petitioner could explain its stand at the panchayat meeting scheduled to be held on November 17. The court did not go into the validity of the notice issued to the company.

The judge added that if the company was aggrieved by the order to be passed by the Panchayat, it could be challenged before the appropriate authority.

The second notice was issued on October 13, asking the company to show cause why its plants should not be closed down. Besides the over-exploitation of ground water sources and the contamination of wells and nearby ponds, the notice cited the recent detection of pesticide residue in its soft drinks and consequent health hazard to the public.

The company said the second notice was issued while its appeal against the first was pending before the Local Administration Secretary.
