Kolkata HC refuses stay on motor tax penalty

MR Justice K.J. Sengupta on Wednesday refused to pass any interim order challenging the West Bengal (Additional and one Time Tax on Motor Vehicles, 2nd Amendment) Act, 2003, which proposed imposing a penalty in case the vehicle owner fails to pay such tax in advance.

The Automobile Association of Eastern India (AAEI) moved the writ petition challenging the Act which levies road tax for 5 years at a time.

The West Bengal Government opposed the petition on the ground that it is a legislative power of a State Government to impose such taxes for a period the legislature may deem fit.
