SC puts off hearing in sell-off cases

THE Supreme Court on Monday stayed further proceedings in a writ petition pending before the Jodhpur Bench of the Rajasthan High Court challenging disinvestment in Hindustan Zinc Ltd (HZL).

A three-judge Bench, comprising Chief Justice Mr V.N. Khare, Mr Justice S.B. Sinha and Mr Justice S.H. Kapadia, also put off hearing by six weeks on petitions challenging disinvestment in Jessop and Co, National Fertilizer Ltd and Engineers India Ltd, as notices issued on them had not been served on the parties concerned.

The petitions pending before High Courts were filed by Mr Milon Mukherjee, NFL Officers' Association, Engineers India Ltd Officers' Association, Mr Rajendra Kumar Razdan and Khetri Tamba Shramik Sangh.

In the Jessop case, the staff association of the company had come before the apex court in appeal against the judgment of the Calcutta High Court.

The transfer of some of the disinvestment cases pending before high courts to the apex court had been sought by the Centre after the Court agreed to reconsider its September 16, 2003, ruling on Hindustan Petroleum Corporation Ltd and Bharat Petroleum Corporation Ltd, which held that the Centre could not privatise the two oil majors without parliamentary approval.
