Pharma sector to make presentations on data protection

THE Government has asked the various pharmaceutical industry bodies to make presentations on the issue of data protection on April 12 when the inter-ministerial panel will meet again.
Informed sources said that the decision to hear out the various points of view held by the industry was taken at the meeting held today. "The Organisation of Pharmaceutical Producers of India, Indian Drug Manufacturer's Association, the Indian Pharmaceutical Alliance and the Bulk Drug Manufacturers' Association have been asked to make presentations on the issue," said sources.
Pharma MNC lobbies have been pushing for at least five years data protection against unfair commercial use, while the Indian companies have been concerned about extension of patent life due to data protection, as this would hurt the generic industry.
While, the Health Ministry has been stating that the existing Drugs and Cosmetics Act cannot monitor data protection and that this should be part of the Official Secrets Act, the Government is examining Article 39.3 of TRIPS (Trade Related Intellectual Property Rights) under the World Trade Organisation to clarify whether it is essential for Governments to protect data produced by the Originator.
