Dumping probe on certain rubber chemicals from China

THE Designated Authority in the Commerce Ministry has initiated anti-dumping investigation into the import of certain rubber chemicals known technically as MBT, MBTS, CBS (accelerator chemicals) and PVI originating in or exported from China. The products are mainly used in automotive tyre and tubes industry and also in conveyor belting and footwear industry among others.

In an initiation notification, the Authority in the Directorate General of Anti-Dumping and Allied Duties said that it received a written petition from National Organic Chemicals Industries Ltd (NOCIL), requesting for initiation of anti-dumping probe for levy of anti-dumping duties on the subject goods.

Detailing accelerators chemicals, it said MBT in technical parlance is 2-Mercapto Benzothiazole, MBTS as Dibenzothiazole disulphide and CBS as N-cyclohexyl-2-benzothiazole sulphonamide. For pre-vulcanization inhibitor/retarder chemical, PVI is used and its chemical description in N- (Cyclohexylthio) pthalmide.

The petitioner contended that each individual product included in the application is a stand-alone product and does not have inter se substitutability with other rubber chemicals. These are specific chemicals used in specific recipe used for manufacture of different types of rubber products and could not be substituted for other chemicals though they are generally known as accelerators and inhibitors. The products are being directly imported by the tyre industry and also by traders for supply to other industries. The consumers are using the domestic and corresponding import products interchangeably.

The Authority said that there is sufficient evidence that normal value of the subject goods in the subject country is significantly higher than the net export prices, indicating prima facie that exporters are dumping the subject goods in the Indian market.

The period of investigation is January 1, 2003 to end-December 31, 2003, while the injury investigation would however cover the period 2001-02 to 2002-03, the notification said.
