Kerala HC orders `status quo' over Castle

A DIVISION Bench of the Kerala High Court today restrained the State Government from taking over the remaining buildings adjoining the Halcyon Castle and the property.
The Bench comprising Mr Justice K.S. Radhakrishnan and Mr K. Thankappan issued the direction while ordering that status quo be maintained with respect to the takeover of the Castle, its adjoining buildings and the property. The directions came on an appeal filed by the M-Far hotel group against a single judge order rejecting its plea for staying the Government order taking over possession of Halcyon Castle and its adjoining buildings.
The Government issued the order on the ground that the Castle and its property had not been sold to the India Tourism Development Corporation (ITDC), from which the M-Far group reportedly "purchased" the property.
In its petition, the M-Far group contended that the State Government had no right or power to take over the property already sold to the group.
