IPA opposes patent law that will hurt generics

THE Indian Pharmaceutical Alliance (IPA) has written to the Group of Ministers (GoM) looking into the amendments to the Patent Act, reiterating that all its members opposed patent applications meant to delay the entry of generic drugs.
The IPA has been of the opinion that the applications for molecules discovered before 1995 should not be considered by the Government, as this would hurt the generics business. "The IPA wishes to clarify that there are no differences among its members, including Ranbaxy, on this issue," the IPA President, Mr Habil Khorakiwala, said. "We fully support IPA's position on patents," said Mr Brian Tempest, CEO of Ranbaxy. "Patentability, if not defined clearly in the law, will not only lead to litigation, but also result in `extensions' of patents, depriving the public of access to generics after the expiry of the main patent," he said.
IPA added that pre-grant opposition to patent applications, as provided in Section 25 of the Act, should be retained and not done away with as proposed in the Bill. The GoM is in favour of allowing both pre-grant and post-grant opposition to companies.
