HC directs BSNL to maintain status quo on RIM connection — Asks Reliance to deposit Rs 40 cr

IN a breather to Reliance Infocomm's 90-lakh subscribers, the Delhi High Court on Friday asked Bharat Sanchar Nigam Ltd (BSNL) to maintain status quo on its interconnection with the private operator till a final decision is taken.

BSNL had threatened to disconnect Reliance on grounds that the latter was routing international long distance (ILD) calls illegally.

The Court's order means that Reliance subscribers can continue to call 5 crore BSNL subscribers. The direction came from a Division Bench of the Delhi High Court comprising Mr Justice Vijender Jain and Mr Justice Anil Kumar who also directed Reliance Infocomm to deposit Rs 40 crore with BSNL by November 8, as an interim measure.

The Court has also asked BSNL to file its reply to the private operator's appeal and has posted the matter for further hearing on November 30.

In an interim order, the Court also directed Reliance to file an affidavit confirming that it has stopped the routing of international calls as local ones.

Reliance had filed an appeal with the Division Bench of Delhi High Court after a single judge order quashed the company's appeal for an interim relief against BSNL's threat of disconnection. Following the single judge's order on Thursday, BSNL had given an ultimatum to Reliance seeking payment of dues amounting to Rs 255 crore by Friday or face disconnection.

Reliance Infocomm, in its first official statement since the controversy began a month ago, said: "We had filed an appeal before the Division Bench of Delhi High Court against the order of single judge refusing interim relief. The Division Bench of Delhi High Court has directed BSNL to maintain status quo and has directed Reliance to deposit a further amount of Rs 40 crore. The matter is subjudice."

Company sources said that BSNL was unjustified in asking for payment even in areas where there were no records of the alleged violation. They said that Reliance was prepared to sit across the table with BSNL to resolve the issue.
