Sports Delhi cricket body told to conduct AGM, elections

New Delhi , Nov. 9 CRICKET battles are not only being fought on the field but also in court rooms. First, it was the election of Mr Jagmohan Dalmiya as Patron-in-chief of the Board of Control for Cricket in India (BCCI) that was mired in legal tangle. Now, local associations like the Delhi & District Cricket Association (DDCA) will also have to follow a tribunal's orders for conducting their annual general meetings and election of officer-bearers. The Company Law Board (CLB) has directed the DDCA to hold its AGM due for July 4, 2003 on December 20. The Association has been asked to conduct elections of office-bearers and members of executive committee under the chairmanship of Mr Justice Jaspal Singh, former Delhi High Court Judge. Mr Justice Singh would have the authority, if required, to engage a professional such as a practising company secretary to assist him in conducting the elections, the Board said. The Board gave this directive following a petition filed by a DDCA member seeking directions to call for an AGM that should have been held in July 2003, on the ground that the executive committee has wilfully defaulted in holding the meeting. In his petition, the petitioner has also sought for a direction that the office bearers or the members of the executive committee of the Association who have ceased to be so be restrained from representing themselves as such. While the BCCI was founded under the Societies Act, the DDCA is an Association registered under Section 25 of the Companies Act, without any share capital. Currently, it has about 4,200 members. In fact, last October, the Supreme Court heard two petitions filed by BCCI and Mr Dalmiya challenging an interim order passed by the Madras High Court superseding the Board and appointing a retired judge of the apex court as interim administrator to manage its affairs. The final hearing is slated for November 30.
