Authenticity of Priyamvada's 1982 will questioned

THE hearing in the discharge of caveat case filed by the four Birlas in the will of Priyamvada Devi Birla, came up for hearing before Mr Justice Kalyan Jyoti Sengupta of the Calcutta High Court on Wednesday.

Resuming arguments, Mr Anindya Mitra, counsel for Mr R.S. Lodha, executor of the will of Priyamvada Birla, submitted that the Birlas have intentionally published a `set-up' will of M.P. Birla and Priyamvada Birla purported to have been executed in 1982, for creating caveatable interest of the Birlas; as such, the court should not entertain the caveats filed by Birlas asking intervention, he submitted.

Mr Mitra cited various case laws of different courts to show that the Birlas do not have caveatable interests in M.P. Birla and Priyamvada Birla estates.

He reiterated his earlier arguments that since M.P. Birla was never an executor of the will of Priyamvada Birla, allegedly made in 1982, the question of nomination of any executor in place of M.P. Birla does not and cannot arise. The hearing will resume on Thursday.
