Corporate Disputes Corporate - Corporate Disputes Ambanis seek `settlement' proof from Mukesh Ambarish Mukherjee
New Delhi , Dec. 6 THE battle lines are finally being drawn between the two Ambani brothers, Mr Mukesh and Mr Anil, over control of Reliance. As a precursor to what may have far-reaching consequences for the Rs 90,000-crore Reliance empire, the Ambani family members have asked the Reliance Chairman, Mr Mukesh Ambani, to provide "evidence and appropriate details of the ownership issues," which he claimed had been settled by the late Dhirubhai Ambani during his lifetime, company sources told Business Line. The family is believed to have asked Mr Mukesh to provide details of the "settlement" Dhirubhai had made about distributing his fortunes to his children after his death. Dhirubhai's wife, Ms Kokilaben, and his two daughters, Ms Dipti and Ms Neena, have also asked for evidence that would prove beyond doubt that Dhirubhai had actually wanted such a settlement. However, the Ambanis have orallyasked Mr Mukesh to provide the details and not in writing. Mr Mukesh a public statement last month, had stated that all ownership issues had been settled by Dhirubhai. He had also mentioned that he is making the public statement because he wanted to set the record straight. Following Mr Mukesh's statement, it was reported that other family members were not aware of any such settlements, and if actually he had settled them, then the family members would abide by his wishes. But now, company sources said they have put the onus on Mr Mukesh to provide evidence in support of what he had said. According to the provisions laid down in the Indian Evidence Act, evidence can be either oral or written. In case of written evidence, handwritings and signatures are subject to verifications to prove their authenticity. In case of oral evidence, there have to be witnesses who will vouch that they were present during the conversation when matters were settled. Mr Mukesh has not yet disclosed whether there are any evidences or in what form they are.
