Lodha caveat: Hearing on Tapuria plea begins

THE hearing of an application filed by Mr K.N. Tapuria seeking discharge of the caveat filed by Mr R.S. Lodha in the 1982 will of the late M.P. Birla and the late Priyamvada Birla began in the Calcutta High Court on Wednesday.

Mr S. Sarkar, Counsel for Mr Tapuria, argued that Mr Lodha was neither an heir of the Birla family nor was he in any way connected with the Birlas. As such, he cannot have any caveatable interest in the will of M.P. Birla and Priyamvada. He further argued that Mr Lodha is not accepting the doctrine of mutual will.

Rather he is challenging its reality, and therefore, how can he ask for caveatable interest in the mutual will, he said. Hearing will continue.

Meanwhile, in another proceedings before the High Court, Mr Ram Jethmalani, Counsel for Mr R.P. Pansari, complainant in the criminal proceedings (in the Lodha matter), has opposed the petition filed by Mr S.N. Prasad, one of the accused seeking quashing of criminal proceedings against him.
