Call for effective dispute redressal mechanism

MR Justice T.Ch. Surya Rao of the Andhra Pradesh High Court has stressed the need to have an effective dispute resolution mechanism in the country and advised the Indian Council of Arbitration (ICA) to bring pressure on the Parliament on the issue.

He was addressing a gathering after inaugurating a seminar on `Intellectual Property Rights (IPR) in Pharma, IT and other industries-Dispute Resolution', organised by the Federation of Andhra Pradesh Chambers of Commerce and Industry (FAPCCI) and ICA here on Saturday.

According to Mr Justice Surya Rao, the problems that should concern everyone appeared to be how best to resolve disputes faster and at less expense . He viewed that this was an area that was ignored by the Parliament and felt there was laxity on part of legislators who have to formulate legislation.

The ICA Executive Director, Mr G.K. Kwatra, said so far the courts were being used for the process of dispute resolution and that arbitration was not yet familiar to many. He said an amendment to the Arbitration and Conciliation Act of 1996, was pending before Parliament.

This amendment seeks to establish a mechanism, wherein the courts can refer cases for arbitration process instead of admitting them for proceedings in the courts.
