A DIVISION Bench of the Kerala High Court has held that lotteries which hold certificates for payment of sales tax on the date of the lottery ban order should be treated as valid for sale and could conduct draw on scheduled dates.

The Bench, comprising the Chief Justice, Mr B. Subhashan Reddy, and Mr Justice A.K. Basheer, issued the direction while disposing of an appeal filed by the State of Nagaland and a petition filed by an agency of Bhutan and Sikkim lotteries.

According to the agency, since the ban order was issued, the draw of lotteries could not be conducted on the scheduled dates. The ban order came into effect on January 27.

The court had earlier allowed lotteries of other States to be sold and put to draw provided sales tax had been paid. The court had made it clear that police could take action if there was any violation of the court order.
