Dispute resolution policy for `.in' domain names soon

WITH the first set of complaint of cyber-squatting hitting the `.in' domain name registration process, National Internet Exchange of India (NIXI) is now on an overdrive to finalise `.in' domain name Dispute Resolution Policy'.

The draft policy is being given a final shape before it goes to the IT Department for approval. It talks about a time-bound dispute resolution process that would mostly be conducted online.

``The designated registry, NIXI, has received 10 to 15 complaints of cyber-squatting, but the dispute resolution process can be initiated only after announcement of the policy and appointment of arbitrators,'' sources said.

While the registry has already received about half a dozen applications for appointment of arbitrators, it is looking at widening the ambit of response by issuing fresh Expressions of Interest to ensure a nation-wide reach.

The proposed policy sets out terms and conditions to resolve disputes arising out of registration and use of `.in' domain name. A dispute can arise if a domain name, registered by a party, is similar to a name or trademark in which a complainant has a right; or when a domain name has been registered or is being used in bad faith.

"Bad faith" is likely to entail those circumstances which indicate that the registrant has registered a domain name for selling or transferring it to the complainant who is the actual owner of a trademark. It would also extend to acquisition of a domain name for selling it to a competitor (of the complainant) for a consideration.

When contacted, NIXI's Acting CEO, Amitabh Singhal, declined to comment on the specifics of the proposed policy, but said, "We have received some complaints of cyber-squatting in the corporate domain name space which will be addressed by the arbitration process. The policy is aimed at deterring cyber-squatters."
