Birlas move HC seeking intervention

Our Legal Correspondent

Kolkata , May 10

The Birlas on Tuesday filed an application in the High Court here seeking the court's intervention, allowing Special Officers to break open the almirahs and chests belonging to the late Ms Priyamvada Birla.

The court had appointed three Special Officers on an application of the sister of late Mr M.P. Birla for making an inventory of the goods left behind by Ms Priyamvada Devi and the late Mr Birla in Mumbai, Kolkata and Allahabad.

The matter may be placed before Mr Justice Kalyan Jyoti Sengupta for hearing on Wednesday.

The Special Officers are allegedly encountering difficulties, and the almirahs and chests are not in possession of the Birlas, hence, the order has been prayed for.

The Birlas have also filed an appeal in the Calcutta High Court challenging the order dated March 11, 2005 passed by Mr Justice Sengupta with regard to the caveatable interests of the Birlas. The appeal shall be placed before a Division Bench comprising Mr Justice P.C. Ghose and Mr Justice P.N. Sinha.

Mr Justice Sengupta in his order discharged the caveatable interest of Mr K.K. Birla, Mr B.K. Birla and Mr Y. Birla, retaining that of Mr S.K. Birla in the probate of the will left behind by Ms Priyamvada Birla.
