Bombay Dyeing moves court against Pantaloon

BOMBAY Dyeing has moved court against Pantaloon Retail (India) over its manufacture and sale of Beautycale - a product Bombay Dyeing says closely resembles its popular bedsheet brand Beaucale.

A Bombay Dyeing & Manufacturing official said that when Bombay Dyeing came to know of Beautycale, it moved court on June 15, getting an ex parte order.

A court receiver was then appointed.

On June 16, Pantaloon's warehouse at Tarapur and its Big Bazaar outlets in Thane and Mulund were raided and 200-250 Beautycale bedsheets recovered.

According to the Bombay Dyeing official, Beautycale is "deceptively similar to our Beaucale, which is 35-40 years old.

A number of things have been copied. — the font, colour combinations and the label and it is being sold at Big Bazaar outlets."

The court receiver is expected to give his report in two weeks.

However, when contacted, a Pantaloon spokesperson said that, had the issue been brought to the company's notice, it may well have considered Bombay Dyeing's request to remove the product off its shelves. However, Bombay Dyeing chose to go to court. The product was then removed from the shelves.

The spokesperson added that the product was being manufactured by a vendor who sold it under the `Beautycale' label and hence Pantaloon had nothing to do with the issue.

However, the Bombay Dyeing official refuted this claim saying that the packaging of Beautycale clearly indicated that the product was manufactured and marketed by Pantaloon. Pantaloon has promised to provide the high court details of the bedsheet manufacturer in a week.
