Clubs registered as cos cannot claim service tax waiver

CLUBS registered as companies under the Companies Act would not be entitled for the service tax exemption that would otherwise be available for bodies established under a law by Parliament, a top Finance Ministry has clarified.

"We had sought the view of the Law Ministry on this. Their view is that clubs may be bodies formed and registered under the Companies Act, but they are not bodies established under law. The service tax exemption would be available for bodies established under law by Parliament," Mr R. Sekar, Joint Secretary, Finance Ministry, said at a service tax conference organised by the PHD Chamber of Commerce and Industry (PHDCCI).

He also said that Finance Ministry would soon issue a formal clarification on this issue.
