No final word yet on regulator's powers: Shahi

UNDER fire from the Central and State power sector regulators, the Power Ministry on Thursday said that its reported move to dilute the regulatory establishment's tariff-setting power was only in a "proposal stage" and that the Centre was open to changes on the issue.

"These are only proposals put forward after consultations with various stakeholders, State Governments and others. Our stand is very flexible and a decision is yet to be taken," said the Power Secretary, Mr R.V. Shahi.

In its proposals, the Ministry had suggested amending the Electricity Act 2003 to change the term `the regulators shall be guided by' with the words `shall act in conformity with' government policies such as the National Electricity Policy and Tariff Policy. Besides the regulators, the Finance Ministry and the Planning Commission have also opposed the Power Ministry's proposals. The Central Electricity Regulatory Commission (CERC) Mr A.K. Basu has already met Power Minister Mr P.M. Sayeed in this regard.

Mr Shahi said the changes were proposed as some states had raised concerns regarding functioning of regulatory bodies. On the long-pending National Tariff Policy, Mr Shahi said that the CERC has agreed to the draft policy and its objections relate to the application of the policy.
