CLB order on Birla Corp challenged in Calcutta HC

AN order of the Company Law Board (CLB) dismissing a petition seeking investigation into the affairs of Birla Corporation Ltd (BCL), a company of the M.P. Birla Group, has been challenged in the Calcutta High Court.

One Gouri Sankar Kayan, and two others, have filed an appeal challenging the CLB order passed on April 25, 2005.

While moving the appeal, counsel for Mr Kayan stated that the CLB did not consider in its order the question of who was the person actually controlling the shares of Priyamvada Devi in BCL, after the death of Priyamvada Birla.It is a fit case for investigation and the CLB order should be set aside with a direction to rehear the matter, the counsel submitted.

The counsel for BCL stated that CLB in its order observed that the result of Annual General Meeting (AGM) showed that Mr R.S. Lodha was the person controlling the affairs of BCL.
