Regulatory Bodies & Rulings Joint appellate tribunal for power, petroleum likely Our Bureau
New Delhi , Sept. 13 AS a first step towards having an integrated regulatory framework in the energy sector, the Government is planning to have a combined appellate tribunal for both the power and petroleum sectors. The tribunal would function as a quasi-judicial body to hear appeals against the decisions of the power sector regulatory establishment and the proposed oil sector regulator. "We are working on a proposal to have a combined appellate tribunal for the power and petroleum sectors. A broad consensus on the proposal has emerged in the Committee of Secretaries meetings," the Power Secretary, Mr R.V. Shahi, said here at a panel discussion on power sector reforms. The Planning Commission has also supported the proposal of a single tribunal for power and petroleum sectors, he said, adding that a formal decision was yet to be taken on the issue. The Power Ministry has already set up an appellate tribunal for adjudicating disputes among players in the power sector. Under the provisions of the Electricity Act 2003, the Centre was required to constitute the appellate tribunal for electricity to hear appeals against the orders of the adjudicating officer or the Central and State Electricity Regulatory Commissions. Further reinforcing the idea of integration in the energy sector, Mr Shahi said, "If we are to regulate power prices, it would not be right to leave input fuel prices unchecked. It would be only a mater of time that fuel used by the power sector also be brought under a single regulatory regime." The Planning Commission Deputy Chairman, Mr Montek Singh Ahluwalia, favoured a single energy regulator that would oversee all energy-related sectors such as coal, petroleum and power. "Ministries are quite happy with the idea of a single tribunal and we can have a single regulator as well," he said.
