Calcutta HC Bench refuses stay on jute gunny bags order

A DIVISION Bench of the Calcutta High Court comprising Mr Justice P.C. Ghose and Mr Justice N.C. Sil on Wednesday refused to grant stay of the order dated August 2, 2005 passed by the Trial Court, directing the Jute Commissioner of India (JCI) to continue with the system of giving orders for manufacturing jute gunny bags. (This practice had been prevailing in May 2005.)

The Trial Court had restrained JCI from introducing new sets of parameters for manufacturing such bags. While refusing to pass any order, the Division Bench disposed of the appeal filed by JCI with the direction that the Trial Court shall hear out the case.

Agarpara Jute Mills, along with other jute mills, filed the case challenging the authority of JCI for setting up new parameters for the modernisation of jute mills, as they adversely affect these mills while obtaining orders of jute gunny bags in a small quantity.
