SC notice to BSNL on Walky row

THE Supreme Court on Monday issued a notice to Bharat Sanchar Nigam Ltd on an appeal filed by Tata Teleservices Ltd seeking a stay on a demand of Rs 250 crore by the state-owned company on account of Access Deficit Charge (ADC).

The Court directed BSNL not to disconnect the points of interconnection with Tata Teleservices till the matter is heard.

A bench comprising Mr Justice Arijit Pasayat and Mr Justice Arun Kumar sought a reply from BSNL within two weeks. Late last week, BSNL had directed all its circle units to issue disconnection notice to Tata Teleservices for non-payment of access deficit charges while offering fixed wireless telephone services - Walky. In a notice sent to all the circle heads across the country on September 29, BSNL has said that the Tata company be given 30 days time to pay up the dues after which the points of interconnection will be disconnected without further notice.

Tata Teleservices in its appeal has questioned the unilateral decisions of BSNL, which were "anti-competitive" and severely hurting the future growth of fixed line services in the country. The Telecom Dispute Settlement Appellate Tribunal had earlier upheld BSNL's stance and had ruled that `Walky' was a mobile service and therefore it was right on the part of the PSU to demand ADC from Tata Teleservices.
