Mining & Quarrying AP Govt to levy cess on minerals Our Bureau
Hyderabad , Oct. 4 IN an effort to raise resources and to improve infrastructure in the mining sector, the State Government has introduced an enabling legislation that will allow the State Mining Department to levy tax (cess in this case) in addition to royalty. The Andhra Pradesh Mineral Bearing Lands (Infrastructure) Cess Ordinance 2005, promulgated on September 11, will now be replaced by an enactment once passed by the State Legislative Assembly. This was introduced by the State Minister for Mines and Geology, Ms P. Sabitha Reddy. According to statement on objects and reasons, the Supreme Court in a recent judgement relating to the mining sector, in the case of Kesoram Cements and West Bengal, held that cess levied on land is valid. Consequently, the Andhra Pradesh Government has decided to levy cess on mineral produce. This would cover mining lands and help provide and improve the infrastructure for exploitation of mineral resources in the State. NALA Act: In yet another Bill, The Andhra Pradesh Non Agricultural Lands Assessment Act (NALA), the State Government plans to repeal the NALA. The Government in its new industrial policy had ordered exemption of all industrial units from levy of NALA with effect from April 1, 2000 to March 31, 2005. Based on industry representation, the Government has decided to abolish NALA by repealing the Andhra Pradesh NALA Act, 1963, in its present form and to introduce levy in lumpsum at the rate of 10 per cent of the basic value of the land in arrears as may be fixed by the Government. Skanska Contract: Earlier in the day, the matter relating to award of irrigation contract to Skanska Cementation Ltd, by allegedly flouting tender norms, rocked the House, with the State defending the award of the contract and the Opposition seeking Government clarification.
