Excise and Customs Industry & Economy - Gems & Jewellery CBEC to handle disputes over branded jewellery K.R. Srivats
New Delhi , Jan. 3 THE Finance Ministry has decided to have its say in cases where a jeweller contests that the jewellery sold by him is not branded and therefore cannot be subjected to excise duty. To avoid harassment to the jewellery trade in such situations, the Central Board of Excise and Customs (CBEC) has now asked its excise field formations to refer such cases to the Board. A similar approach has been suggested in cases where the Commissioner is in doubt and not in a position to decide whether the particular jewellery is branded or not. With the Union Budget for 2005-06 levying a 2 per cent excise duty on branded jewellery, the determination of whether the jewellery is branded or not has revenue implication for the Government. The CBEC has now said through a circular that all references to the Board should be sent through zonal chief commissioners, giving full details and relevant documents indicating why the particular jewellery should be treated as branded. The Finance Ministry has also said that no precipitate action should be taken to charge excise duty on such jewellery till such time as the Board decides the matter. The Ministry's move to decide on such matters comes in the wake of certain instances being brought to the notice of the CBEC where some jewellers have been "forced to pay excise duty and jewellery has reportedly been seized".
