`K.K. Birla can contest probate'

MR K.K. BIRLA has several grounds to challenge the grant of probate for the Will of Priyamvada Birla (made in 1999) to the executor. The counsel of Mr Birla stated this before the division bench of Justice Mr Pinaki Chandra Ghose and Justice Mr Tapan Kumar Dutt of Calcutta High Court in the appeal proceeding filed, challenging the order of the Trial Court refusing caveat-able interest of Birla Group save one.
The counsel concluded his argument stating that Mr K.K. Birla was co-owner of an orchard with the late Priyamvada Birla. It was submitted that he is also a member of the larger Birla family, and has an ancestral relationship with Mr M.P. Birla, moreover he is the co-executor of the Will of Mr M.P. Birla made in 1982, and has every right to file a caveat which the Trial Court did not accept. Under the circumstances, the order of the Trial Court should be stayed and Mr K.K. Birla should be allowed to contest the probate proceeding, the counsel further submitted.
