HC dismisses Lodhas' writ plea

Kolkata, March 18

Justice Jayanta Kumar Biswas of the Calcutta High Court on Friday dismissed all the three writ petitions filed by Mr R.S. Lodha, a CA himself, and his two sons, challenging the show cause served by the Institute of Chartered Accountants of India (ICAI). The notice was based on a complaint filed by three Kolkata-based CAs, alleging professional misconduct. In a long proceeding, counsel of Mr Lodha agitated that the complaints against them do not have any basis and was based on malice and vindictiveness. It was also argued that the Birla Group might have spearheaded the attack as Mr Lodha is fighting a battle against Birlas in a probate proceeding of the will of Priyamvada Birla. The court, while dismissing the applications, also said that the rejection petition of Lodhas is not maintainable, and as such rejected. The Lodhas shall follow the laid down principles of the institute and everything should be done in accordance with that, it held.
