HC fixes June 21 for hearing of appeal by Lodha

A Division Bench of the Calcutta High Court comprising Mr Justice P.C. Ghose and Mr Justice T.K. Dutt has fixed June 21 as final date of hearing of the appeal filed by Mr R.S. Lodha against the order of the Trial Judge, who appointed four Administrators over the M.P. Birla Estate.

On May 19no sooner than the Trial Court passed the order, Mr Lodha moved the Division Bench and obtained a stay over the order of the Trial Court; the hearing of the case was fixed for June 13.

Counsel of Mr Lodha on Tuesday prayed for stay of the entire judgment of the Trial Court, as the court has exercised jurisdiction, counsel submitted, in excess of its authority, superseding the Board of Directors of M.P. Birla Group of Companies.

Trial Court

For the first time, the State Advocate General appeared in this case on behalf of G.P. Birla and opposed the prayer of the Lodha counsel, stating that the Division Bench has already stayed the Trial Court's order. He further stated that since the copy of the judgment was received only on June 12 and could not be pursued, an adjournment was prayed for.
