Cell phone provider asked to compensate for delay in activation

Chennai , Aug. 15

The District Consumer Disputes Redressal Forum, Chennai (North), has directed a Chennai-based mobile phone seller and the Airtel cell phone provider to compensate a city advocate for alleged failure to provide the local activation and national roaming facility to his mobile phone within the assured time.

The Forum - consisting of Mr G. Frederick Kanagaraj, President, and Mr. J. Kadirvel, Member I (in charge) - while allowing the complaint of Mr S.P. Chocalingam, Alapakkam, asked Univercell Communications, dealers of Nokia cellular phone, and Bharti Televentures Ltd, providers of Airtel connection, to compensate the complainant jointly and severally by paying Rs 5,000 for his suffering and hardship.

Both the parties were also directed to pay a sum of Rs 2,000 to the advocate towards expenditure incurred by him.

According to the complainant, he bought a Nokia mobile phone from Univercell and subscribed for Airtel connection through former by depositing Rs 2,750 to avail himself of national roaming facility.

Univercell had assured him that local connection would be activated on the same day and the national roaming facility in three days.

The complainant alleged that the opposite parties failed to provide the facility as per the assurances made by them.
