Courts/Legal Issues HC directs Ministry to decide on Madras Fert chief Our Legal Correspondent
The petitioner said that based on several complaints, the CVC, in consultation with the CBI, had also gone into the complaints against him.
Chennai , Sept. 6 A Division Bench of the Madras High Court has directed the Secretary, Department of Fertilisers, Government of India, to consider the various allegations made by a public litigant against the present Chairman and Managing Director of the state-owned Madras Fertilisers Ltd and "dispose them of one way or the other in accordance with law." Disposing of a public interest litigation preferred by Mr L. Viswanathan, an ex-employee of the undertaking, the Bench consisting of Mr Justice P. Sathasivam and Mr Justice S. Manikumar, said that according to the petitioner, several representations were still pending in respect of the CMD with Secretary, Home Affairs, Government of India (Respondent 1) and Secretary, Department of Fertilisers. "We are of the view that ends of justice would be met by directing the 2nd respondent to consider and dispose of these representations specified in the affidavit in accordance with law." According to the petitioner, the fifth respondent Mr Sukumar Oomen, CMD, who was a retired IAS officer, was removed from the post of Chairman, Kerala Electricity Board, due to his indifferent attitude and was appointed as CMD of MFL in September 2002. He started indulging in activities that were not in the interest of the company, with the result that production in the factory fell to a great extent. The petitioner said that based on several complaints, the Central Vigilance Commission, in consultation with the Central Bureau of Investigation, had also gone into the complaints against him. He pleaded action to remove him from the post of CMD.
