HC allows Dalmiya's revision petition

Mr Justice S.P. Talukdar of the Calcutta High Court on Wednesday allowed a revisional petition of Mr Dinesh Dalmiya alleging that the Chief Metropolitan Magistrate (CMM), Calcutta had failed to consider the beginning of statutory period of 90 days, which commences from February 27, 2006, the day Mr Dalmiya surrendered before the Chennai Court.

The CMM Calcutta refused to accept the contention of Mr Dalmiya, observing that the statutory period of 90 days was being calculated from March 13, 2006, the day he was produced before the CMM Court.

Mr Dalmiya filed the revisional petition challenging the order of CMM, Calcutta.

The court allowed the petition accepting the submission made by his counsel about the statutory period, which commences from February 27, 2006. The court further held that the trial court would consider the issue in the light of the observation made by the High Court.

Mr Dalmiya is the prime accused in the Rs 120-crore Calcutta Stock Exchange scam , and a chargesheet was filed by the investigating authority. The trial court will now consider the bail petition in the context of the current development.
