HC order to examine viability of Vallarpadam container project

A Division Bench of the Kerala High Court has directed the concerned authorities to examine the viability of the rail alignment connecting the proposed container transhipment terminal project at Vallarpadam before starting the work.

The direction was issued by the Court while disposing of a review petition filed by a few landowners who challenged the land acquisition for the rail link to the proposed site. The Court directed the landowners to file an application seeking to examine the viability of the project before the concerned authorities.

It said that the authorities concerned could not have undertaken such a mammoth project without examining its viability. It also observed that before starting the project, the respondents would examine the viability in the light of the contentions made by the petitioners.

The Government Pleader submitted before the Court that a notification under the Kerala Land Acquisitions Act had been issued and that it was done after assessing the project feasibility. Earlier, the Court had rejected a batch of writ petitions challenging the alignment with an observation that matters like these are best suited to be decided by an expert body.

Meanwhile, senior port officials when contacted said that the Court's directive would not have any impact on the project as its orders did not seem to be very serious. The port had given all the relevant papers to the State Advocate General and is awaiting a final decision.
