7-day week for Bata: HC asks Commissioner to consult union

Grant of exemption to employers by competent authority under the TN Shops & Establishment Act, 1947 from declaring weekly holiday as working day could not be done mechanically; authority was to be satisfied that employer was entitled to exemption, the Madras High Court has held.

Whenever an application was made by an employer for grant of exemption, the authority concerned should cause notice to be published in the premises of establishment or through newspapers so that the union to give its response. A final decision would be taken after considering materials placed before the authority.

The court said this in a dispute between Bata India Ltd and its labour union over whether or not Bata could order a 7-day working week.

Fixing of weekly rest day is been founded on usage and changing it to some other day of rest might seriously prejudice employees, the court said.
