Book Fair plea: Calcutta HC dismisses petition

The Calcutta High Court today dismissed the writ petition filed by the Publishers' & Book Sellers' Guild (Guild), seeking permission from the court to hold the 32nd Calcutta Book Fair at Kolkata Maidan.

While dismissing the petition, filed as public interest litigation (PIL), the Division Bench comprising Mr Justice B. Bhattacharjee and Mr Justice K.K. Prosad observed that the present petition was not at all maintainable as PIL. The court further held that the Guild moved this petition on the ground that the Army who were the custodians of Maidan had told the Guild that if the High Court gives permission, the Army had no objection to the holding of the fair.

The court held that if a landlord refuses permission to a tenant saying the tenant has to go to High Court for obtaining passport for staying, the court shall not bother to entertain such a plea.

The court further held that at this stage the case made out in the petition did not come within the preview of PIL as laid down by the Supreme Court. The court, however, made it clear that the order of rejection does not stand in the way of the Guild from proceeding in the appropriate forum.
