Canadian court rules in Ranbaxy's favour

Ranbaxy Laboratories has announced that the Federal Court of Canada has favoured it in a judgement on a patent dispute with Pfizer. In an official statement, the company said that the court had found Pfizer's Canadian patent of the cholesterol lowering drug, atorvastatin, CA 2,021,546 invalid on the grounds that Pfizer had not "correctly and fully describing the invention."

Mr Jay Deshmukh, Senior Vice-President (Global Intellectual Property), Ranbaxy, said: "We are pleased with this decision as it stands, as it allows the entry of Ranbaxy's generic atorvastatin in Canada upon marketing approval."

Pfizer, whose branded version Lipitor accounts for almost half of its profits, has said in a statement that it would challenge the ruling. Ranbaxy and Pfizer are in legal dispute over patents on atorvastatin in several courts around the world.
