HC directs Erode transport institute to reinstate 5 guards

Chennai Feb. 14 The Madras High Court has directed Erode-based Institute of Road Transport Technology, a Tamil Nadu Government undertaking, to reinstate five security guards who were removed from their job by the management on the ground that they were engaged by contractors.

Dismissing a writ appeal by the management, a Division Bench, comprising Mr Justice P. Sathasivam and Mr. Justice N. Paul Vasanthakumar, upheld the order of the single judge saying the alleged contract was only a sham. "We are not inclined to interfere with the said factual findings of the single judge," they said.

The five security guards (respondents) contended that the Assistant Security Officer of the appellant allotted them work. Their grievance was that due to non-regularisation, they were denied basic wages and DA among other benefits.

They said the management victimised them and denied them a job. They raised a dispute before the Labour Court, Erode, pleading for regularisation of service. The court dismissed the claim of the workmen.
