Chennai Feb.23 A Division Bench of the Madras High Court, which has been hearing a batch of petitions by Norvartis AG against challenging the rejection of its patent application by the Assistant Registrar for beta crystalline form of imatinib mesylate, vis-à-vis validity of Section 3(d) of the Indian Patents Act, 1970, on Friday decided to refer to the Chief Justice, for orders, the issue of converting the writ petitions into writ appeals.

The Bench, comprising Mr Justice R. Balasubramanian and Mrs Justice Prabha Sridevan, had already heard the views on the subject of Mr Shanthi Bhushan, senior counsel for the Company. According to him, the question of adopting a different nomenclature was immaterial, more so when the Court had jurisdiction.
