Publication of award by labour courts in gazette dispensed with: HC

Chennai April 23 The stipulation that awards of labour courts should be published in Government gazette has been dispensed with, and power had been delegated to the State Government under Section 17(1) of Industrial Disputes Act to publish the same on notice board, the Madras High Court has held.

Rejecting a contention by petitioner R.K. Leathers (P) Ltd, Ranipet, that an award of the Labour Court, Vellore, sanctioning a claim by one Vachala under claim petition was inoperative as said award had not been gazetted, Mr Justice K. Chandru said the argument that award had not been gazetted fell to the ground.

The claim petition that had been filed under Section 33-C(2) of the Industrial Disputes Act was only to compute the benefits of the award. The requirement that such award should be published in official gazette had been dispensed with. Hence, the writ petition was dismissed.
