New Delhi May 3 The Union Cabinet on Thursday gave its nod for the proposed Airport Economic Regulatory Authority (AERA) Bill, which seeks to create a level playing field and foster healthy competition among all airports within the country.

The Bill will now have to be passed by Parliament before the authority can be formally set up. The proposed authority would also seek to encourage investments in airport facilities, regulate tariff of aeronautical services, protect the reasonable interest of the users apart from ensuring that the airports operate in an efficient, economic and viable manner.

It would consist of three persons including a chairperson and two persons, to be appointed by the Union Government from among those having adequate knowledge and professional expertise in aviation, economic law, commerce or consumer affairs.

Functions

The function of AERA would be to determine tariff structure for aeronautical services taking into consideration capital expenditure incurred and timely investment in improvement of airport facilities, service provided, its quality and other relevant factors, cost of improving efficiency among others.

Besides, it would also determine the quantum of development fees for major airports, determine passenger service fee to be levied under the Aircraft Rules, monitor the performance standards relating to quality, continuity and reliability of service as also call for information as may be necessary to determine the tariff.

The proposed Authority will also have penal powers to penalise for wilful failure to comply with its orders and direction of the AERA Act, punish for non-compliance of the orders of the Authority apart from penalising for offences by companies.
