IPR Corporate - Courts/Legal Issues Amul trademark case: Gujarat HC upholds ruling Our Bureau Ahmedabad, Sept. 27 In a significant development, the Gujarat High Court has upheld an earlier order of the Anand District Court restraining two shop-owners here from using the Amul trademark. Mr Justice D.K. Patel of the High Court ruled that a registered trademark user has the right to restrict others using it for different class or goods. The contention of using a trademark for a long time, without permission, was not acceptable as a recurring wrong can be prevented at any stage and time, Amul said in a release here. Local shop-ownersThe Kaira District Cooperative Milk Producers’ Union Ltd and the Gujarat Cooperative Milk Marketing Federation had filed trademark infringement cases against two local shop-owners — Anand Chasmaghar, an optician, and Amul Cutpiece Stores, a cloth merchant — in the District Court, Anand.
