New Delhi, Sept. 27 The Finance Ministry expects to notify within a week the guidelines for determining fair market value (FMV) of stock options or sweat equity shares issued to employees.

The determination of FMV was necessary to compute the fringe benefit tax on employee stock option plans (ESOPs). “The Finance Minister has given his approval and the guidelines would be notified within a week,” official sources said.

The Finance Ministry had recently given more time for payment of first and second instalment of advance FBT on ESOPs and set the due date for this purpose at December 15, which was the due date for the third instalment.

The move to give more time to pay these instalments came in the wake of the absence of appropriate guidelines from the Central Board of Direct Taxes for determining the fair market value of such options or sweat equity shares.
