New building rules come into force for Tier-II cities

Uniformity of guidelines will ease paperwork


The order brings in clear guidelines that are in force in Chennai to the smaller cities. As of now, the Town and Country Planning Act does not provide for such clear cut DCR.

Chennai, Oct. 5 Tamil Nadu has taken a step towards simplifying planning permission procedures and bringing in organised development in urban areas across the State by enabling uniform guidelines for real estate development.

Through a recent order that came into effect on October 1, the Development Control Rules (DCR) of the Chennai Metropolitan Development Authority will serve as the guidelines for local authorities, builders and real estate developers seeking plan permission and Floor Space Index approval in Tier-II cities — Coimbatore, Madurai, Tiruchi, Salem and Tirunelveli – and in Mamallapuram Local Planning Area.

This is seen as a significant move among the real estate developers in facilitating projects in these cities and enabling planned development. The tier-II cities are seen as the next major destination after Chennai for investments by the manufacturing and the IT sectors.

With the uniformity in guidelines, developers would find it relatively easy in getting the paperwork done.

More importantly, they point out, the order brings in clear guidelines that are in force in Chennai to the smaller cities. As of now, the Town and Country Planning Act does not provide for such clear cut DCR.

This resulted in haphazard development and cities just being ‘over grown villages.’

The order by the Office of the Commissioner of Town and Country Planning follows a series of discussions on addressing the confusion over the various rules and regulation under the Town and Country Planning Act, the Tamil Nadu District Municipalities Act and Panchayat Act and other related rules.

The order says that as a first step the DCR of the Chennai Metropolitan Development Authority (CMDA) would be enforced in these local planning areas till the Government approves separate rules for each area.

The separate DCR would be on the pattern of the CMDA rules, which would prevail when there is a conflict with the rules under the Local Bodies Act.
