Tribunal stays ban on Red FM

New Delhi, Oct. 5 The Telecom Disputes and Settlement Appellate Tribunal (TDSAT) on Thursday stayed the ban on radio channel, Red FM, for its comments on the Gurkha community.

The Ministry of Information and Broadcasting had on Wednesday decided to ban the channel for a week on the ground of the sensitive comments that had got aired.

TDSAT said that its interim order which stated that the Ministry could carry on the proceedings against the channel would continue conditional to the outcome of the case in the tribunal.

The radio channel on its part argued that the Ministry did not abide to the 15 days mandatory notice period and took a hasty decision. However, the Ministry counter argued stating that it was the duty of the radio channel to ensure that any kind of content which would hurt anybody’s sensitivities should not be aired and by banning it for such a time was an effective way to prevent such kind of occurrences.
