Our Bureau, New Delhi, Nov. 9 Ranbaxy Laboratories has announced an out-of-court agreement with Japanese company Astellas and US subsidiary of German pharmaceutical company Boehringer Ingelheim (BIPI) with regards to the billion dollar plus drug Flomax (Tamsulosin capsules). The case related to one Astellas’ US Patent covering Tamsulosin and its use in the treatment for functional symptoms of benign prostatic hyperplasia has been dismissed without prejudice. An earlier injunction against Ranbaxy was also vacated. The Gurgaon-based pharmaceutical’s Tamsulosin capsules will now enter the US markets on March 2, 2010. The company will not only launch the drug eight weeks prior to expiration of the paediatric exclusivity, but is also likely to be the only generic player during the period to do so. Ranbaxy claims, its Tamsulosin Abbreviated New Drug Application (ANDA) is the first substantially complete ANDA with a Paragraph IV certification to particular patent.
