Politics Industry & Economy - Courts/Legal Issues States - West Bengal Nandigram firing unconstitutional: HC Our Legal Correspondent Kolkata, Nov 16 Delivering the long awaited judgment on the Nandigram Police firing on March 14, 2007, a Division Bench of the Calcutta High Court comprising Chief Justice Mr S.S. Nijjar, and Mr Justice P.C. Ghose today directed the CBI to continue investigation in terms of the order passed by this court on March 15, 2007. While delivering 172 pages judgment, the Bench held that the action of the police at Nandigram on March 14 was unconstitutional and cannot be justified. The court further directed the State Government to pay compensation of Rs 10 lakh each to the kin of the 14 deceased in the firing, Rs 8 lakh to be given as compensation to the rape-victims, Rs 5 lakh each to the 162 injured person and Rs 2 lakh each to the persons allegedly molested, whose names appear in the PIL petition. The court also held that the Advocate General’s argument, relating to the statement made by the Chief Minister on the floor of the Assembly, welcoming the order of the High Court about CBI investigation cannot be accepted. The AG had argued that while opposing the investigation, the Chief Minister, being a political personality, might have made a statement in the floor of the Assembly which is not the voice of Government.
