Judge sets store by mediation

Mumbai, Dec 14 Mediation as a means of effective out of court settlement of conflicts found acceptance in the conference chaired by Mr Justice D. Y. Chandrachud, Bombay High Court, at K C College.

Book released

The book Settle for more – The why, how and when of Mediation, authored by Mr Sriram Panchu, senior advocate, Madras High Court, was the source of discussion, where he spoke about the need to promote mediation . He explained how the risk-free method was being inculcated in to the existing system in Mumbai, Chennai and Allahabad and removing some of the burden of cases from the courts.

“Mediation allows people to resolve disputes and engage them in long term interests. It helps in saving the drain in resources happening at present,” said Mr Panchu.

There are 140 mediators in Chennai with mediation centres in nine districts, handling more than 2,000 cases, he said, explaining how the method is being well received in Tamil Nadu. A lot of these mediation centres function at night, and are evening courts, he added.

Good for lawyers

Removing fears of lawyers, who feel threatened by this method, Mr Chandrachud said: “Lawyers are an important part of this process. It will not be counterproductive to the existence of lawyers, but they can become mediators and develop an alternate practice to settle cases.”

Mostly, the cases that can be settled out of court through mediation deal with matrimony, custody, commercial as well as property. This art of beneficial compromise deals with ending a dispute well, not bitterly, he concluded.
