SC relief for Haldia Petro

In an interim order, the Supreme Court today allowed Haldia Petrochemicals to pay the fees of the CAG appointed auditors for auditing the company’s accounts for 2006-07. According to sources, the interim order was passed despite stiff resistance from The Chatterjee Group – the private partner in the company. According to legal experts, the interim order apparently upholds the State Government claim that Haldia Petrochemicals is a Government controlled company a s per 619((B) of the Companies Act therefore making it mandatory on the company to get its accounts audited by CAG appointed auditors. TCG, which is opposing the state control over the company, were against holding CAG audit and opposed payment of auditors’ fees. —
