Murrali Chennai, Feb. 1 Hearing on the intellectual property row between TVS Motor Company and Bajaj Auto over the use of digital twin spark plug engine technology entered the fourth day on Friday with counsel of both the companies putting forth their arguments to the single judge of the Madras High Court. The primary argument of counsel appearing for Bajaj Auto was that before Bajaj launched DTSi technology in 2003, nobody in the world had launched any motorcycle using the technology. Bajaj’s counsel argued that the third valve introduced in the TVS patent was superfluous since it does not open until the throttle opens fully. His contention was that TVS copied the three essential features of Bajaj’s patent — the small-bore engine of 45-70 mm, lean burn air-fuel mixture, and twin spark plug. TVS counsel argued that the DTSi technology, claimed to be invented by Bajaj Auto, was not valid due to lack of novelty, and inventiveness. The arguments will continue on Monday.
