PIL against book fair dismissed

Kolkata, Feb. 22

Adivision bench of Calcutta High Court comprising Mr S.S. Nijjar and Justice P.C. Ghose today dismissed the public interest litigation challenging the decision of State Government to hold the Book Fair 2008 at the Salt Lake Stadium. While dismissing the application, the court held that it was not maintainable and that the petitioner had no locus standi to move such a PIL.The petition was filed on the ground that the West Bengal Cabinet had not granted approval for holding such a fair and no State budgetary provision had been set apart for the event. The petitioner further alleged that if the fair was allowed to be held from March 1 to March 10, it would clash with the schedule of the IFA Shield Football Tournament.The Counsel for the State opposed the petition stating that since the fair would be held outside the compound of the stadium, there was no question of the holding of the football tournament being interfered with. Further, irrespective of whether the decision to hold the fair was approved by the Cabinet or not, the Court could not adjudicate on the administrative matter, Counsel added.-Our Legal Correspondent
